Town of Amherst Plan Commission Minutes – December 7, 2017 approved

Call to Order:At 6:30 p.m.
Roll Call:Kadow, Blenker, Spierings, Nilsen, Netzel and Olson. In attendance as well were Arlene Trzebiatowski, Ron and Pat Kaszubski, James Stack, Bruce Groshek, Tracy Pelky, Tommy Enright, Deann and Ryan Kolodziej.

Approval of Monthly Minutes:October minutes were read and M/S Blenker/Spierings to approve the minutes as read. M/C.
Kolodziej Request to Rezone property located at 4755 Lime Lake Road, parcel #600-23-1030-07.03 from Rural Limited and Conservancy. The request is only to rezone portions of the property zoned Rural Limited and leave lands currently zoned Conservancy unchanged. The requested A3 Low Density Agricultural zoning would allow farming and farming related activities. Kolodziej questioned why a driveway was not approved for his property. After discussion, it was suggested that he submit a driveway permit application and the proper procedures would be followed as are currently in place. The Kolodziejs questioned when the Town of Amherst adopted zoning which included Rural Limited and Conservancy. It was explained that the County adopted this two tier zoning and the townships were obligated to review zoning for the entire town and adopt the two tier zoning. This involved a long process in which town constituents were notified via various means and opportunities were presented to review the changed zoning prior to adoption and public hearings were held as well prior to an ordinance amending the Town of Amherst Comprehensive Plan. The Kolodziejs also are concerned with losing legal protection under the Right to Farm Act should their property remain under Rural Limited zoning versus Agricultural. The Kolodziejs are under the belief that they owned animals on this property prior to the adoption of the Amendment to the Town of Amherst Comprehensive Plan in which portions of their property were zoned Rural Limited. If so, a permitted use under Rural Limited states: “Preexisting agricultural uses prior to adoption of this ordinance”. The Kolodziejs will work with Tracy Pelky to provide documentation to establish compliance with this usage under Rural Limited. It was also explained to the Kolodziejs that they could apply for Special Exemption which requires a public hearing/approval by the Board of Adjustment for new and expanded general agriculture. The Kolodziejs withdrew their request for rezoning at this time. Tommy Enright offered to assist the Kolodziejs with developing a plan to present as a special exemption under Rural Limited if they so decide to explore that option.
Lake Ebert Ordinance Update: Kadow read a DNR letter dated October 18, 2017 in which the Town of Amherst Proposed Ebert Lake ordinance was approved. The Town Board has since held a public hearing and adopted the ordinance. Signage needs to be posted per Don Spierings.
Public Comments: No Parking signs on Lime Lake road were reported to be confusing. It was questioned as to whether signs can be more specific. No parking is permitted between the signs.
Speed limit signs were also requested for Lime Lake Road. Discussion ensued as to the effectiveness of posting signs.
